When purchasing a home, whether for your family or as an investment property, it is of the utmost importance that your rights to the land and home are protected. It is a one time cost paid at closing that is valid for as long as you own your property.
Obtaining title insurance is typically handled by your attorney. They will work with both the title company and lender to have title search performed and procure title insurance. Almost all mortgage lenders require a Loan Policy of Title Insurance as a condition of funding your loan to purchase the property, insuring them against many of the same risks covered by an Owner’s Policy as well as additional protections for the validity and enforceability of their loan.
While an Owner’s Policy is not required in North Carolina or South Carolina, it is highly recommended that you obtain one at the time of your purchase. If your lender thinks it is important to protect their investment with title insurance – don’t you think you should protect yourself with an Owner’s Policy, too? Due to the nature of premium calculations in North Carolina and South Carolina, the additional cost for obtaining both a Loan and Owner’s Policy simultaneously is relatively small compared to providing a Loan Policy by itself. BACK POLICY SEARCHES
The use of a title insurance policy from a previous transaction on the same property, regardless of who owned the property at the time, can save you both time and money.
Back policies allow attorneys to limit the period they must search public records, thereby allowing them to perform the searches in a shorter period of time. There is also a premium discount for back policies that meet certain requirements: policies that are for the same property that are less than 15 years old in North Carolina (10 years old in South Carolina) will provide a discount of up to 50% off of the standard premium rate for your transaction.
